Acceptable Use Policy

These acceptable use standards apply to any material you upload or share to our site or generate on our site (“User Content”). They also apply to any contact you make with other users on our site, links to our site, and any other ways you use our site.

You must comply with these standards in spirit as well as to the letter.

Remi & Co NY Family Office Limited (“Remi Family Office”) will determine, in its discretion, whether any User Content or your use of our site breaches these acceptable use standards.

• In any way that breaches any local, state, federal or international law or regulation.
• In any way that is unlawful or fraudulent or has any unlawful or fraudulent purpose or effect.
• For the purpose of harming or attempting to harm minors in any way.
• To bully, insult, intimidate or humiliate any person.
• To send, knowingly receive, upload, download, share, post, use or re-use any material which does not comply with our content standards.
• To transmit, or procure the sending of, any unsolicited or unauthorised advertising, promotional material, or other form of similar solicitation, except where this complies with the CAN-SPAM Act and, for calls or texts, the Telephone Consumer Protection Act (TCPA), and any consent you hold.
• To knowingly transmit any data, or send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware, contrary to (among other laws) the Computer Fraud and Abuse Act, 18 U.S.C. § 1030.

User Content:

• Must be accurate (where it states facts).
• Only contain opinions that are genuinely held.
• Must comply with the law applicable in any place from which it is posted and to which the website is targeted.

User Content must not:

• Be defamatory of any person.
• Be obscene, offensive, hateful or inflammatory.
• Infringe any copyright, trademark, or other intellectual property right of any other person.
• Include video or other content that is, or would likely be classified as, restricted or adult content under applicable content-rating standards.
• Include material that might impair the physical, mental or moral development of persons under the age of 18.
• Be likely to deceive any person.
• Breach any legal duty owed to a third party, such as a contractual duty or a duty of confidence.
• Contain illegal content or promote any illegal content or activity (see ‘Illegal content’ below).
• Be in contempt of court or breach a gag order, protective order or other court order.
• Be threatening, abusive, or invade another person’s privacy, or cause annoyance, inconvenience or needless anxiety.
• Be likely to harass, upset, embarrass, alarm or annoy any other person.
• Impersonate any person or misrepresent your identity or affiliation with any person.
• Give the impression that the User Content emanates from Remi Family Office, if this is not the case.
• Advocate, promote, incite any party to commit, or assist, any unlawful or criminal act, such as (by way of example only) copyright infringement or unauthorized use of a computer.
• Contain a statement which you know or believe, or have reasonable grounds for believing, is likely to be understood as counselling, promoting or facilitating an act of terrorism, contrary to federal law (18 U.S.C. Chapter 113B) or New York Penal Law Article 490.
• Be pornographic, obscene within the meaning of 18 U.S.C. §§ 1460–1470 or New York Penal Law Article 235, or sexually exploit any person.

You must not use our site in any way that involves, promotes, or facilitates any of the following. This list is illustrative and not exhaustive — other federal, state or local laws may also apply:

• Terrorism — offenses under federal law, including 18 U.S.C. Chapter 113B (material support, financing or facilitation of terrorism), and New York Penal Law Article 490.
• Child sexual exploitation or abuse, including child sexual abuse material, luring and grooming — 18 U.S.C. §§ 2251–2260A (federal), and New York Penal Law Article 263.
• Hate crimes — 18 U.S.C. § 249 (federal hate crimes), and New York Penal Law Article 485 and § 240.31 (aggravated harassment).
• Harassment, stalking, or uttering threats — 18 U.S.C. § 2261A (interstate stalking), and New York Penal Law Article 120 (stalking) and § 240.30 (aggravated harassment).
• Non-consensual distribution of intimate images (“intimate image abuse”), including manufactured or deepfake intimate images — New York Civil Rights Law § 52-b and New York Penal Law § 245.15.
• Extreme or obscene material — 18 U.S.C. §§ 1460–1470 (federal obscenity) and New York Penal Law Article 235.
• Sexual exploitation of adults and sex trafficking — 18 U.S.C. §§ 1591, 1581 et seq. (federal), and New York Penal Law Articles 135 and 230.
• Unlawful immigration-related conduct — the Immigration and Nationality Act, 8 U.S.C. § 1101 et seq.
• Fraud and financial offenses — including mail and wire fraud (18 U.S.C. §§ 1341, 1343), identity theft (18 U.S.C. §§ 1028, 1028A), and New York Penal Law Articles 155 and 190.
• Money laundering and proceeds of crime — 18 U.S.C. §§ 1956–1957, and New York Penal Law Article 470.
• Drug and controlled substance offenses — the Controlled Substances Act, 21 U.S.C. § 801 et seq., and New York Penal Law Article 220.
• Firearms and weapons offenses — the federal Gun Control Act, 18 U.S.C. Chapter 44, and New York Penal Law Article 265.
• Counselling or assisting suicide — New York Penal Law § 120.30 (promoting a suicide attempt).
• Foreign interference and unregistered foreign agency — the Foreign Agents Registration Act, 22 U.S.C. § 611 et seq., and 18 U.S.C. § 951.
• Animal cruelty — the federal PACT Act, 18 U.S.C. § 48, and New York Agriculture and Markets Law Article 26.
• Unauthorized use of a computer, or mischief in relation to data — the Computer Fraud and Abuse Act, 18 U.S.C. § 1030, and New York Penal Law Article 156.

The following must not be uploaded, shared or generated directly on this service:

• Pornographic content, or content that sexualises a minor in any way (see ‘Illegal content’ above).
• Content which encourages, promotes or provides instructions for suicide.
• Content which encourages, promotes or provides instructions for an act of deliberate self-injury.
• Content which encourages, promotes or provides instructions for an eating disorder or behaviours associated with an eating disorder.

You must not upload, post, create on our site or share any of the following:

• Content that is abusive and which targets any of the following characteristics: race, creed, color, national origin, sex, sexual orientation, gender identity or expression, military status, marital or familial status, age, disability, or predisposing genetic characteristics — reflecting protected characteristics recognized under the New York State Human Rights Law (Executive Law, Article 15) and applicable federal law, including Title VII of the Civil Rights Act of 1964.
• Content which incites hatred against a person or group distinguished by any of those characteristics, contrary to federal and New York hate-crime law (see ‘Illegal content’ above).
• Content which encourages, promotes or provides instructions for an act of serious violence against a person.
• Bullying content.
• Content which depicts real or realistic serious violence against a person, or the real or realistic serious injury of a person, in graphic detail.
• Content which depicts real or realistic serious violence against an animal, or the real or realistic serious injury of an animal, in graphic detail.
• Content which encourages, promotes or provides instructions for a challenge or stunt highly likely to result in serious injury to the person who does it or to someone else.
• Content which encourages a person to ingest, inject, inhale or otherwise self-administer a physically harmful substance, or a substance in a quantity that would be physically harmful.

You must not upload, post, create on our site, share, or cause any uploading, posting, creation or sharing, of any of the following:

• A message that is indecent, grossly offensive or menacing, sent with intent to alarm, harass or cause harm.
• A false message known to be false, sent with intent to cause injury, alarm or damage, contrary to (among other laws) 18 U.S.C. § 875(c) and New York Penal Law § 240.50 (falsely reporting an incident).
• A message threatening death or serious bodily harm, contrary to 18 U.S.C. § 875(c) and New York Penal Law § 240.30 / § 120.15 (menacing).
• A communication that intends to encourage serious self-harm.
• An unsolicited sexual image, including a manufactured intimate image or “deepfake,” sent with intent to cause the recipient alarm, distress or humiliation, contrary to New York Civil Rights Law § 52-b and New York Penal Law § 245.15.
• A sexually explicit deepfake of any person.

For any User Content in the form of video content, you must tell us immediately if you upload a video containing: criminal material relating to terrorism, the sexual exploitation of children, hate propaganda, or other content described in ‘Illegal content’ above.

You must not upload a video containing material likely to incite violence or hatred against a group of persons, or a member of a group, based on race, national or ethnic origin, colour, religion, sex, sexual orientation, gender identity or expression, or mental or physical disability.

You must not upload, post, create on our site or share content containing any advertising or promoting any services or web links to other sites, except with our prior written consent.

Hidden advertising (where a content creator has been paid or otherwise has an incentive to endorse a product but does not clearly identify the content as advertising) is not allowed on our site, and may also violate Section 5 of the FTC Act (15 U.S.C. § 45) and, in New York, General Business Law §§ 349–350 (deceptive acts and practices; false advertising), as well as the FTC’s Endorsement Guides (16 C.F.R. Part 255).

• You must not upload a video or other content containing advertising for tobacco products, vaping products, or prescription-only medicine, reflecting the advertising restrictions in the Family Smoking Prevention and Tobacco Control Act (21 U.S.C. § 387 et seq.), FDA deeming regulations, and, in New York, Public Health Law Article 13-F.

Any advertising included in content you upload must not:

• Prejudice respect for human dignity.
• Include or promote discrimination based on a characteristic protected under federal, New York State, or other applicable state or local human/civil rights law.
• Encourage behaviour prejudicial to health or safety.
• Encourage behaviour grossly prejudicial to the protection of the environment, or make environmental claims that could contravene the FTC’s Guides for the Use of Environmental Marketing Claims (the “Green Guides”) (“greenwashing”).
• Cause physical, mental or moral detriment to persons under the age of 18.
• Directly exhort persons under 18 to purchase or rent goods or services in a manner that exploits their inexperience or credulity.
• Directly encourage persons under 18 to persuade their parents or others to purchase or rent goods or services.
• Exploit the trust of persons under 18 in parents, teachers or others.
• Unreasonably show persons under 18 in dangerous situations.

You must use the functionality provided on our site to declare whether, as far as you know or can reasonably be expected to know, any content contains advertising.

Fake reviews are not allowed on our service. Fake reviews include reviews that conceal that the reviewer has been incentivised in some way to post the review, or where the review contains information that is false or misleading, contrary to the FTC’s Trade Regulation Rule on the Use of Consumer Reviews and Testimonials (16 C.F.R. Part 465), Section 5 of the FTC Act, and, in New York, General Business Law § 349.
